The U.S. Department of Homeland Security (DHS) and U.S. Immigration and Customs Enforcement (ICE) recently announced the sunsetting of Form I-9 COVID-19 flexibilities. The I-9 flexibilities were initially launched in March 2020 due to the COVID-19 pandemic and were extended until now.
With the temporary flexibilities scheduled to expire on July 31, 2023, employers that have been taking advantage of such flexibilities provided by DHS and ICE will have until August 30, 2023 to ensure that all required physical inspection of identity and employment eligibility documents is completed.
